Privacy Policy

This Privacy Policy explains how ELVTE Fitness (“ELVTE,” “we,” “us,” or “our”) collects, uses, discloses, retains, and protects information when you use the ELVTE website, application, and related services (collectively, the “Service”).
1. Scope
This policy applies to information processed through the Service and communications with us. It does not govern third parties that operate under their own privacy policies.
ELVTE is a consumer fitness service. It is not a healthcare provider, health plan, or healthcare clearinghouse, and use of ELVTE does not create a patient-provider relationship. Information you enter may not be protected by HIPAA.
2. Information we collect
Information you provide directly
- Account details, including name, email address, authentication information, and profile settings.
- Profile information, including age, sex, height, weight, goals, experience, consistency, equipment, available training days, workout duration, and exercise preferences.
- Fitness and wellness information, including workouts, sets, repetitions, weights, pace, distance, duration, exertion, endurance sessions, bodyweight, steps, recovery entries, streaks, personal records, achievements, and XP.
- Nutrition information, including foods, meals, serving sizes, calories, macronutrients, saved meals, barcode searches, and nutrition targets.
- Information about injuries, physical limitations, pregnancy or postpartum status, or health-related considerations that you voluntarily provide.
- Support requests, feedback, survey responses, and other communications.
Information collected automatically
- Device, browser, operating-system, language, and application version information.
- IP address, approximate location derived from IP, timestamps, referring pages, pages viewed, feature interactions, and diagnostic or crash information.
- Authentication, security, and fraud-prevention events.
Information from integrations
ELVTE may later allow you to connect device-health platforms, wearable services, or other third-party integrations. We will request permission before accessing connected data. The types of data available depend on the integration and the permissions you grant. You may disconnect an integration through the relevant provider or ELVTE settings when available.
3. Sensitive information
Fitness, nutrition, physical limitation, pregnancy/postpartum, recovery, and performance information may be sensitive. We use this information to provide requested features, personalize the Service, maintain security, and comply with law.
Do not submit information you do not want associated with your ELVTE account. ELVTE does not use sensitive information to infer characteristics for advertising.
4. How we use information
- Create, operate, maintain, and secure your account.
- Generate and adapt training, endurance, nutrition, recovery, schedule, step, XP, achievement, and progress features.
- Synchronize information across devices and preserve your preferences and history.
- Authenticate users, detect abuse, investigate suspicious activity, and protect ELVTE and its users.
- Respond to support requests and send service-related communications.
- Monitor reliability, diagnose errors, conduct analytics, and improve features and user experience.
- Comply with applicable law, enforce agreements, and establish or defend legal claims.
5. Automated recommendations
ELVTE uses rules, calculations, and automated processing to personalize training and nutrition recommendations based on information such as your goals, schedule, profile, and logged performance. These recommendations may be inaccurate or incomplete and are not medical decisions.
You may change profile information, replace exercises, adjust your schedule, or stop using a recommendation. Contact us if you have questions about how your information affected a recommendation.
6. How we disclose information
We may disclose information in the following circumstances:
- Service providers: vendors that provide hosting, authentication, databases, infrastructure, email delivery, payment processing, nutrition-data access, analytics, security, or customer support. They may process information only to provide services to us or as otherwise permitted by law.
- Legal and safety: when reasonably necessary to comply with law, legal process, or government requests; enforce agreements; investigate fraud or abuse; or protect rights, safety, and property.
- Business transactions: in connection with financing, due diligence, merger, acquisition, reorganization, bankruptcy, or sale of assets, subject to appropriate confidentiality protections.
- With your direction: when you request or authorize disclosure.
- Aggregated or de-identified information: information that is reasonably designed not to identify you.
7. Service providers currently used
ELVTE currently relies on third-party infrastructure that may process account, technical, or Service data:
- Supabase for authentication, database hosting, and account data storage.
- Vercel for application hosting, content delivery, deployment, and technical logs.
- Government or commercial nutrition-data sources for food, barcode, and nutrient information when those features are used.
Additional providers, such as payment, analytics, email, crash reporting, or connected-health providers, may be added as the Service evolves. We will update this policy when a material change affects how personal information is processed.
8. Sale, targeted advertising, and profiling
ELVTE does not sell personal information for money. ELVTE does not currently share personal information for cross-context behavioral advertising or use personal information for targeted advertising.
ELVTE does not currently make decisions that produce legal or similarly significant effects through profiling. If these practices change, we will update this policy and provide any legally required controls before the change applies.
9. Cookies and local storage
ELVTE and its service providers may use cookies, browser local storage, session storage, and similar technologies to keep you signed in, preserve onboarding and plan settings, secure the Service, remember preferences, measure performance, and diagnose errors.
Browser controls may allow you to block or delete these technologies, but doing so may prevent authentication, onboarding, saved plans, or other features from working correctly.
10. Retention
We retain information only for as long as reasonably necessary for the purposes described in this policy:
- Account and profile data: while your account is active and for a reasonable period after deletion to complete the deletion process, prevent fraud, and meet legal obligations.
- Workout, nutrition, progress, schedule, and activity data: while your account is active or until you delete the data or request account deletion.
- Security, diagnostic, and technical logs: for a limited period appropriate to security, debugging, and legal requirements.
- Transaction records: for the period required by tax, accounting, payment, and consumer-protection laws.
- Backups: until overwritten through normal backup cycles, subject to access restrictions.
We may retain information longer when required by law, needed to resolve disputes, or necessary to establish, exercise, or defend legal claims.
11. Your privacy rights
Depending on where you live and subject to legal exceptions, you may have the right to:
- Confirm whether we process your personal information.
- Access or obtain a copy of personal information.
- Correct inaccurate personal information.
- Delete personal information.
- Obtain portable data where required.
- Opt out of sale, targeted advertising, certain sharing, or qualifying profiling.
- Restrict or withdraw consent for processing based on consent.
- Appeal a refusal to act on a privacy request where applicable.
- Exercise privacy rights without unlawful discrimination.
ELVTE does not currently sell personal information or use it for cross-context behavioral advertising, so there is presently no sale or targeted-advertising activity to opt out of.
12. Submitting a privacy request
Submit access, correction, deletion, portability, withdrawal, or appeal requests by emailing support@elvtefitness.com from the email associated with your account. State the request clearly and identify your state or country of residence.
We may verify your identity before completing a request. An authorized agent may submit a request where permitted by law, but we may require proof of authorization and direct identity verification. We will respond within the time required by applicable law.
Account deletion removes access to the account and initiates deletion of associated personal information, subject to legal, security, backup, fraud-prevention, and recordkeeping exceptions.
13. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect information, including managed authentication, access controls, encrypted network communications, database security controls, and restricted production access.
No system is completely secure. You are responsible for using a unique password, protecting your email account and devices, and promptly notifying us of suspected unauthorized access.
14. Security incidents and health-data breaches
We maintain procedures for investigating security incidents. When required, we will notify affected individuals, regulators, or others of a breach. Certain consumer health applications may be subject to the Federal Trade Commission’s Health Breach Notification Rule even when HIPAA does not apply.
15. Children and teenagers
ELVTE is not directed to children under 13, and we do not knowingly collect personal information from children under 13. Users under the age of legal majority must have permission from a parent or legal guardian.
Contact us if you believe a child under 13 has provided personal information. We will investigate and delete the information where required.
16. International users
ELVTE is operated from the United States. Information may be processed and stored in the United States and other locations where our service providers operate. Those locations may have data-protection laws different from the laws where you live.
Where required, we will use legally recognized safeguards for cross-border transfers.
17. Third-party services and links
The Service may link to or rely on third-party websites, databases, payment services, device platforms, or integrations. Their privacy practices are governed by their own policies. We are not responsible for third-party privacy or security practices.
18. Changes to this policy
We may update this policy as ELVTE, our vendors, or applicable law changes. We will post the revised version with a new effective date. When legally required, we will provide additional notice or request consent before a material change applies.
